Terms of Use
§ 1 - Scope & defence clause
(1) The legal relationships established through this system between SXmail.de and its customers are governed exclusively by the following terms of use in their respective version, from the time of registration until deletion of the account.(2) Deviating provisions of the customer are rejected.
§ 2 - Conclusion of the contract
Registration creates a non-binding contract between the customer and the operator of the site. It can be cancelled at any time.§ 3 - Warranty
As we cannot guarantee the availability of our servers, temporary outages and, in the worst case, data loss may occur. We accept no liability for your data - please back it up yourself for emergencies.§ 4 - Activation of the user
You are obliged to log in with your user account within seven days, otherwise it will be deleted.§ 5 - Inactivity
We reserve the right to delete user accounts that have not been used for more than a year (an IMAP or POP3 login counts as activity). The stored messages are lost in the process.§ 6 - Multiple accounts
Registering multiple times is permitted under certain conditions: you must inform the site operator about it.§ 7 - Spam
SXmail.de does not permit sending advertising without the recipient's request. Sending emails in large quantities, in a short time, as well as insulting others, is also prohibited. Depending on the extent of the damage caused, a violation leads to suspension for a certain period or deletion of the user account.§ 8 - Uploading files
The use of the upload feature on SXmail.de is only possible to a limited extent. Copyrighted files may only be uploaded for private purposes and must not be distributed. Illegal files are not wanted and must not be uploaded.§ 9 - Disclaimer of liability
Claims for damages by the customer are excluded unless otherwise stated below. The above disclaimer also applies in favour of the legal representatives and vicarious agents of the provider, insofar as the customer asserts claims against them.§ 10 - Changes to the terms of use
SXmail.de reserves the right to amend the general terms and conditions at any time. The user will be notified of any change.§ 11 - Exclusion
We reserve the right to delete anyone who violates the general terms and conditions from our system together with all their data.§ 12 - Data protection
SXmail.de does not pass on any data to third parties. Information collected is used exclusively to improve our service. Further information can be found in our privacy policy.§ 13 - Choice of law & place of jurisdiction
(1) The contractual relationships between the provider and the customer are governed by the law of the Federal Republic of Germany. Excluded from this choice of law are the mandatory consumer protection provisions of the country in which the customer has their habitual residence. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.(2) The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the provider is the provider's registered office, provided the customer is a merchant, a legal entity under public law or a special fund under public law.
